These Terms of Service govern use of the Velvet Wing Bakery website and our ordering, custom-request, payment, pickup, and related customer services. By using the website or placing an order, you agree to these Terms.
Last updated: September 8, 2026Velvet Wing Bakery is a bakery business based in Biloxi, Mississippi. References to “Velvet Wing,” “we,” “us,” or “our” mean Velvet Wing Bakery. We do not publish a private home address on this website. Where a physical address is legally required, such as on certain product labels, it may be provided through the applicable product or transaction materials.
You may use this website only for lawful purposes and in a way that does not interfere with the website, its security, customer accounts, ordering systems, checkout, connected services, or other users. You may not attempt to bypass access controls, probe for vulnerabilities, automate abusive requests, scrape protected areas, impersonate another person, or use the site to commit fraud or other unlawful activity.
The website may be browsed by users of different ages. If you are under the age of legal majority where you live, any purchase must be completed or authorized by a parent or legal guardian who accepts responsibility for the order and these Terms.
Our products are handmade in small batches. Photos and descriptions are intended to represent the general appearance and character of an item, but natural variation in color, texture, decoration, size, finish, and presentation may occur. Menu items, flavors, designs, availability, pickup windows, and pricing may change without prior notice.
Custom work is planned from the information you provide, including event date, serving needs, flavors, colors, themes, inspiration images, and requested details. Inspiration photos are treated as creative direction and do not guarantee an exact copy of another baker’s work, copyrighted design, decoration, or photograph. We may adapt a design for feasibility, food safety, structural integrity, ingredient availability, production limits, or brand style. Material changes will be discussed when reasonably possible before production.
A quote is based on the information available at the time it is provided and may change if the scope, quantity, ingredients, design, timing, taxes, fees, or other requirements change. Submitting a form, adding an item to a cart, or requesting a date does not guarantee acceptance or reserve capacity. An order becomes confirmed only when we expressly accept it and any required payment has been received.
Unless Velvet Wing Bakery expressly approves an exception, a minimum payment of 50% is required to reserve an agreed date and time for a custom or event order. Full payment is required before production begins. A date or time is not locked in until the required reservation payment has been received. We may approve different arrangements in individual circumstances at the owner’s discretion.
Payments may be handled by third-party payment processors or connected commerce services. Those providers may process payment credentials and transaction information under their own terms and privacy practices. Velvet Wing Bakery does not guarantee that every payment method will be available for every order.
Contact us as soon as possible if you need to change an order. Whether a change or reschedule can be accepted depends on production timing, ingredients and materials already purchased, custom decorations already prepared, staffing, capacity, and the nature of the requested change. Additional charges may apply when a change increases cost or requires rework.
Because bakery products are perishable and custom orders often require advance purchasing, design work, preparation, and reserved production time, refunds are evaluated based on the status of the order when cancellation is requested. Amounts reasonably attributable to ingredients, materials, custom supplies, design work, labor, or production already committed may be non-refundable. Once production has begun or an order has been completed, a refund may be unavailable. Refunds are generally subject to owner approval, and exceptions may be made when appropriate. If Velvet Wing Bakery cancels an accepted order or cannot fulfill an order for reasons within our control, we will provide an appropriate refund for the unfulfilled portion, which may include a full refund when nothing can be fulfilled.
Customers are responsible for arriving within the confirmed pickup window or communicating promptly when delayed. Products are perishable and may be sensitive to heat, humidity, sunlight, movement, and handling. After pickup or other transfer to the customer, the customer is responsible for safe transport, storage, temperature control when applicable, and timely consumption. We are not responsible for damage caused after transfer by improper handling, transport, storage, display, weather exposure, or other conditions outside our control.
Velvet Wing Bakery operates as a cottage food operation in Mississippi. We take food safety seriously and follow the food-safety, handling, storage, labeling, and allergen requirements applicable to our cottage-food operation. Certain products may carry the legally required statement explaining that they were made in a cottage food operation that is not subject to Mississippi’s food safety regulations. That statement describes the regulatory classification of the operation and should not be read to mean that safe food handling is unimportant to us.
Ingredient and allergen information is provided where applicable, and customers should tell us about allergies or dietary concerns before ordering. Our kitchen handles multiple ingredients and we do not guarantee an allergen-free environment or zero cross-contact unless we expressly confirm otherwise in writing for a specific product. Customers with severe allergies or medically necessary restrictions should decide whether a cottage-kitchen product is appropriate for them based on the information we provide.
If you believe there is a problem with an order, contact us promptly and provide the order details and, when helpful, photographs showing the issue. Because products are perishable, timely notice helps us understand what occurred and determine an appropriate response.
If customer-account features are available, you are responsible for keeping your credentials secure and for activity performed through your account. Provide accurate contact, order, and pickup information and update it when necessary. We may restrict or disable access when reasonably necessary to protect the website, customers, or connected services.
Velvet Wing Bakery may offer optional SMS or electronic communications for security and two-factor authentication, order and billing updates, loyalty and rewards, marketing and promotions, or other specifically disclosed purposes. Enrollment is purpose-specific and is not preselected. Consent to marketing messages is not a condition of purchase. Message frequency varies, standard message and data rates may apply, and recipients may use available opt-out instructions such as STOP or HELP where supported. Consent to one purpose does not automatically enroll you in another.
Mobile phone numbers, SMS opt-in records, and SMS consent information are not sold or shared with third parties for their own promotional or marketing purposes. Service providers may process this information only as reasonably necessary to deliver, secure, or operate the requested communications.
If you submit a review, testimonial, photo, message, design request, or other content, you represent that you have the right to submit it and that it does not violate another person’s rights. Unless a specific submission flow states otherwise, submitting customer content does not transfer ownership to Velvet Wing Bakery. You grant us a non-exclusive license to use content as necessary to respond to your request, fulfill the order, operate the service, and, for public reviews or testimonials you intentionally submit for publication, display that content in connection with the bakery.
Website copy, original photography, graphics, logos, brand elements, designs, and other site content are owned by or licensed to Velvet Wing Bakery unless otherwise stated. You may not reproduce, distribute, modify, sell, or commercially exploit protected content without permission, except for ordinary personal use of the website.
The website may connect to payment providers, communications providers, analytics services, social platforms, mapping tools, review services, or other third-party services. Those services are governed by their own terms and privacy practices. We are not responsible for content or practices on third-party websites that we do not control.
We work to keep the website and ordering services available, but we do not guarantee uninterrupted or error-free operation. Features may be modified, suspended, or unavailable because of maintenance, provider outages, capacity limits, security concerns, or other operational needs.
To the fullest extent permitted by law, the website and related online services are provided on an “as available” basis without warranties that they will always be uninterrupted, error-free, or suitable for every purpose. Nothing in these Terms limits rights or remedies that cannot legally be waived, including obligations arising from applicable food-safety, consumer-protection, or other laws.
To the fullest extent permitted by law, Velvet Wing Bakery is not liable for indirect, incidental, special, exemplary, or consequential losses arising from use of the website or circumstances outside our reasonable control. Any limitation in these Terms does not apply where liability cannot lawfully be limited or excluded.
These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law rules. Any dispute that must be brought in court will be handled in a court of competent jurisdiction serving the Biloxi, Mississippi area unless applicable law requires otherwise.
If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later.
We may update these Terms as our website, ordering processes, services, or legal obligations change. The current version will be posted on this page with its updated date. Continued use of the website after an update means the revised Terms apply to future use and transactions to the extent permitted by law.
